Terms and Conditions

I.    Security Arrangement

1. The firm will be responsible for entire security of the Land, Building and Property of the MDNIY at 68, Ashoka Road, New Delhi and Land at Govindpuram Ghaziabad. The security staff will be required to look after the security round the clock at MDNIY New Delhi. However, one gate at Ashoka Road, which remains closed for vehicles, will be maintained by the Chowkidars of the Institute from 6.00 A.M. to 10.00 P.M.
2. The manpower provided by the Agency shall be well versed in security, trained and experienced.
3. The Agency shall provide at least 50% Ex- Servicemen of the total number of Security Guards etc.. If there is any change in the staff, it shall be intimated to the  Director, MDNIY.
4. The requirement of MDNIY can be increased/ decreased at any later stage depending upon the actual requirement of the MDNIY with advance notice of seven days.
5. The Agency shall be responsible to provide immediate replacement to take place of any staff who is not available for duty at the place of posting and such other additional staff as may be required for additional area for which prior information shall be given.
6. The responsibility of providing reliever in respect of the workers who are given weekly off also rests with the agency without charging extra.
7. The Agency must ensure that all the Supervisors, Security Guards etc., shall be in the proper uniform along with black shoes, badges, torch etc. and these uniforms etc. shall be provided by the contractor.
8. The Agency shall be responsible for all security measures and arrangement to safeguard the property and if any encroachment is made by any body or there is any loss of property due to theft etc. the same shall be the responsibility of the agency.
9. The Agency shall indemnify the property of the Institute for the theft, loss pilferage from the area entrusted to control and shall be responsible for all such losses. The Security staff so deployed shall have proper knowledge with regard to safety and Security of the Property.
10. The duty timings will be assigned in consultation with the MDNIY, as per requirement.

IV        General Conditions:

1. The tender forms may be obtained from the office of MDNIY 68, Ashok Road New Delhi -110001 upto 25-09-08 by 5 P:M and deposited by hand or sent by post at the Institute on or before 26.9.2008 upto 5:00 P.M.  The Technical and financial Bids shall be submitted in sealed envelops separately superscribing “Tender for providing Security Services ” .The Technical Bids will be opened on 27.9.2008 at 11.00 A.M. and the Financial Bids will be opened after the details of technical bids are finalized.  
2. The Technical bid shall be submitted giving complete details of terms and conditions and the financial bid shall contain manpower to be provided with contract charges including material.
3. The Agency shall submit a Demand Draft for Rs.10,000/- (Rupees Ten thousand only) as Earnest Money Deposit (EMD) in favour of Morarji Desai National Institute of Yoga, New Delhi with the financial bid which will be refunded after satisfactory completion of contract period.  In case the agency to whom the contract is awarded fails to provide satisfactory services for the job assigned, its EMD will be forfeited
4. The agency shall attach a copy of their Registration certificate and in case they are paying service tax, a copy of the same may be enclosed.  The details for the last three years may be provided.
5. The Agency staff shall be available during duty hours at the place of their duty.
6. The Agency staff shall work under the over all supervision and directions of Director, MDNIY or any other officer authorized by the Director, MDNIY.
7. The Agency shall be responsible for any dispute between them and their employees deployed at MDNIY for this purpose.
8. In case of any dispute with the Labour Commissioner with regard to any of the problems of workers, the responsibility to sort out this shall be totally of the Agency.
9. In case of any claim of the staff as directed by the Labour Commissioner with regard to the payment of wages, ESI/PF etc., the Agency shall have to bear the same without asking any extra from the MDNIY.
10. If the complete manpower as indicated in the financial bid is not provided on any day during the contract period a sum of Rs.200/- (Rupees Two hundred only) per day per guard/ santry and Rs. 300/- (Three hundred only) per day per supervisor would be deducted as a penalty.
11. The Agency shall submit the proof along with the Bill that they have deposited ESI, PF and Service Tax deducted from the wages of the employees provided at the premises as and also for payment of wages to their employees.
12. Proportionate payment will be made on quarterly basis on submission of bills on completion of each quarter subject to satisfactory services.
13. The Agency shall be responsible to provide all fringe benefits viz, bonus, PF, ESI facilities etc. to their employees deployed at MDNIY.
14. The MDNIY shall have the right to ask for the record of any person deployed by the Agency who is not considered to be competent and ordering for his replacement.
15. The Agency shall not engage any sub contractor or transfer the contract to any other person/ agency.
16. The Agency shall comply with the entire legal requirement and for obtaining licence of contract labour etc. under the relevant laws and no person below the age of 18 years shall be deployed.
17. The contract will initially be awarded for a period of one year which may be extended further, if their services are found satisfactory.
18. The Institute reserves the right to terminate the Contract at any stage, without assigning any reason, with 30 (thirty) days notice.
19. In case the agency discontinues the contract before expiry of contract period, the EMD of Rs.10,000/- will be forfeited without any dispute.
20. All the legal matters arising out of the agreement shall be subject to Delhi jurisdiction.
