Terms and Conditions

1. The tender forms may be obtained from the office of MDNIY 68, Ashok Road New Delhi -110001 and deposited by hand or sent by post at the Institute on or before 26.9.2008 upto 5:00 P.M.  The Technical and financial Bids shall be submitted in sealed envelops separately superscribing “Tender for Annual Maintenance Contract for Sign Boards” .The Technical Bids will be opened on 27.9.2008 at 5:00 P.M. and the Financial Bids will be opened after the details of technical bids are finalized.  
2. The Technical bid shall be submitted giving complete details of terms and conditions and the financial bid shall contain the contract charges with all material.
3. The Agency shall submit a Demand Draft for Rs.10,000/- (Rupees Ten thousand only) as Earnest Money Deposit (EMD) in favour of Morarji Desai National Institute of Yoga, New Delhi with the financial bid which will be refunded after satisfactory completion of contract period.  In case the agency to whom the contract is awarded fails to provide satisfactory services for the job assigned, its EMD will be forfeited.
4. The Technical and Financial bid should be submitted in separate sealed envelope superscribed “Annual Maintenance Contract for Sign. Boards.”
5. The Agency will be responsible for maintenance, repair including replacement of parts/ items including consumable of all sign boards during the contract period at their own cost.
6. All the material/ items such as electric wires, tube lights, chowks, socket etc. of good branded quality shall be used for maintenance and upkeep of the sign board.
7. The Agency shall depute qualified and experienced engineers for upkeep and maintenance of the sign boards during the contract period. 
8. All complaints made before noon shall be attended and shall be rectified the same and the others within 24 hrs.

9. The agency will ensure that the engineer/ mechanic/ labour observe a high standard of conduct and behaviour and do not indulge in any anti-social activities during the course of such deployment.  Also ensure that in no case there will be breach of contract.
10. The Institute shall not be responsible for any physical damage or harm to any manpower deployed the agency during the course of execution of this contract, which will be the responsibility of the agency.
11. If any Sign Board is not repaired within two days, Rs.200/- per day per board would be deducted as a penalty from the quarterly bill.
12. Proportionate payment will be made on quarterly basis on submission of bills on completion of each quarter subject to satisfactory services.
13. The contract will initially be awarded for a period of one year which may be extended further, if their services are found satisfactory.
14. This contract can be terminated by the Institute at any stage without assigning any reason, whatsoever with 30 (thirty) days notice.
15. In case the agency discontinues the contract before expiry of contract period, the EMD of Rs.10,000/- will be forfeited without any dispute.
16. All the legal matters arising out of the agreement shall be subject to Delhi jurisdiction.
